1. Agreement to Terms
Acceptance
By accessing or using the AppointMe mobile application (the "Service"), you agree to be bound by these Terms of Service (the "Agreement" or "Terms"). If you do not agree to these Terms, you must not access or use the Service.
Parties
This Agreement is between you ("you," "your," or "User") and AppointMe ("AppointMe," "we," "us," or "our"), operating the Service.
Age Requirements
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you must have your parent or legal guardian's permission to use the Service.
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms in the app with a new "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. We will notify you of material changes through in-app notification or email.
2. Definitions
For purposes of this Agreement, the following terms have the meanings set forth below:
- Admin: Users with elevated privileges to manage shop details and deactivate shops
- Content: All information, data, text, images, reviews, and other materials uploaded or posted through the Service
- Customer: Users who book appointments and rate shops
- Service Provider: Independent contractors (barbers, salons, etc.) listed on the platform
- Shop: A business profile created by a Shop Owner or Admin
- Shop Owner: Users who manage shop profiles, availability, and bookings
- User Account: Your personalized account on the Service
3. Service Description
Platform Purpose
AppointMe provides a digital platform that connects Customers with Service Providers for appointment booking and scheduling. The Service allows:
- Customers to discover, book, and rate service providers
- Shop Owners to manage their business profiles and availability
- Admins to oversee and maintain shop listings
Scope and Limitations
The Service is provided on an "as available" basis. We do not guarantee:
- Uninterrupted or error-free operation
- Availability of any specific Service Provider
- Accuracy of information provided by Users or Service Providers
- The quality, safety, or legality of services offered by Service Providers
Independent Contractor Relationship
Important: Service Providers listed on AppointMe are independent contractors, not employees, agents, or representatives of AppointMe. AppointMe:
- Does not employ Service Providers
- Does not control the quality, timing, or performance of services
- Does not provide the actual services (haircuts, salon services, etc.)
- Acts solely as a technology platform facilitating connections
Right to Modify or Discontinue
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, for any reason including but not limited to maintenance, updates, or business decisions.
4. User Accounts
Registration Requirements
To use the Service, you must create a User Account by providing:
- Valid phone number
- Full name
- Profile picture (optional)
You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
You acknowledge that AppointMe is not liable for any loss or damage arising from unauthorized access to your account due to your failure to maintain adequate security.
Account Transfer
You may not transfer, sell, or assign your User Account to any other person or entity without our prior written consent.
Account Information Accuracy
You represent and warrant that all information provided in connection with your account is truthful, accurate, and not misleading.
5. User Roles and Responsibilities
Customers
Customers may:
- Browse and search for Service Providers
- Book appointments with Service Providers
- Rate and review shops
- Manage their appointment history
Customers must:
- Provide accurate contact information
- Arrive on time for scheduled appointments or cancel in advance
- Behave respectfully toward Service Providers
Shop Owners
Shop Owners may:
- Create and manage their shop profile
- Upload shop-related images (interior, work samples, etc.)
- Set availability and manage bookings
- Respond to customer inquiries
Shop Owners must:
- Provide accurate business information
- Keep availability calendars up to date
- Upload only appropriate, relevant content
- Honor confirmed appointments or provide reasonable notice of cancellation
Admins
Admins have elevated privileges to:
- Edit any shop details (name, description, pictures, availability)
- Deactivate shops that violate these Terms
- Review and remove inappropriate content
- Monitor platform compliance
6. Acceptable Use Policy
Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms.
Prohibited Activities
You agree not to:
Legal and Safety:
- Violate any applicable local, state, national, or international law
- Engage in any fraudulent, deceptive, or misleading activity
- Impersonate any person or entity or misrepresent your affiliation
- Harass, threaten, or harm other Users
Content:
- Upload offensive, obscene, defamatory, or inappropriate content
- Post content containing nudity, violence, or adult material
- Infringe upon intellectual property rights of others
- Upload malware, viruses, or harmful code
Technical:
- Attempt to gain unauthorized access to the Service or other accounts
- Interfere with or disrupt the Service's functionality
- Use automated systems (bots, scrapers) to access the Service
- Reverse engineer or decompile any part of the Service
- Remove or modify any proprietary notices or labels
Commercial Abuse:
- Use the Service for unauthorized commercial purposes
- Spam or send unsolicited communications to other Users
- Attempt to manipulate ratings or reviews
Consequences of Violations
Violation of this Acceptable Use Policy may result in:
- Content removal
- Account suspension or termination
- Legal action
- Reporting to law enforcement authorities
7. User-Generated Content
Content You Upload
Users may upload Content including:
- Profile pictures
- Shop-related images (Shop Owners)
- Reviews and ratings (Customers)
Content Standards
All Content must:
- Be appropriate for all ages
- Relate to the Service (e.g., shop interiors, hairstyle examples)
- Comply with applicable laws
- Not infringe on third-party rights
Shop-related pictures should only feature relevant content such as the shop's interior, equipment, or service examples.
License Grant
By uploading Content, you grant AppointMe a worldwide, non-exclusive, royalty-free, transferable license to:
- Use, reproduce, and display your Content
- Modify or adapt Content for technical purposes (e.g., resizing images)
- Distribute Content through the Service
- Use Content for promotional purposes
This license continues even after account termination for Content that has been shared or distributed.
Content Ownership
You retain ownership of Content you upload, but you represent and warrant that:
- You own or have the necessary rights to the Content
- The Content does not violate any third-party rights
- You have obtained all necessary permissions and releases
Content Removal
We reserve the right, but have no obligation, to:
- Monitor Content uploaded to the Service
- Remove any Content that violates these Terms
- Remove Content at our sole discretion
- Suspend or terminate accounts that repeatedly violate content standards
Public Nature of Content
You acknowledge that reviews, ratings, and shop images are public and viewable by all users of the Service.
8. Intellectual Property Rights
AppointMe's Intellectual Property
The Service, including all software, text, graphics, logos, icons, images, audio clips, digital downloads, and data compilations, is the property of AppointMe or its licensors and is protected by intellectual property laws.
AppointMe®, the AppointMe logo, and other marks are trademarks of AppointMe. You may not use these marks without our prior written permission.
Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include:
- Resale or commercial use of the Service
- Collection and use of listings or descriptions
- Derivative use of the Service or its content
- Downloading or copying of account information
- Use of data mining or similar tools
Copyright Infringement
We respect intellectual property rights. If you believe your copyright has been infringed, contact us at copyright@appointme.konenas.com with:
- Description of the copyrighted work
- Location of the infringing material
- Your contact information
- A statement of good faith belief
- A statement under penalty of perjury
- Your electronic or physical signature
9. Payment Terms
Current Payment Structure
As of the Effective Date, AppointMe does not process payments for services. All payment arrangements are made directly between Customers and Service Providers.
Future Payment Features
We reserve the right to introduce payment processing features in the future. If implemented, additional terms governing:
- Transaction fees
- Payment processing
- Refund policies
- Chargebacks
will be provided and incorporated into these Terms.
No Liability for Payment Disputes
AppointMe is not responsible for payment disputes between Customers and Service Providers.
10. Disclaimers and Limitation of Liability
Service "As Is" Disclaimer
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability of information
- Uninterrupted or error-free operation
No Guarantee of Service Provider Quality
We do not warrant, endorse, guarantee, or assume responsibility for:
- The quality of services provided by Service Providers
- The accuracy of shop information or reviews
- The conduct of any User or Service Provider
- Appointment availability or fulfillment
Limitation of Liability
To the maximum extent permitted by law, AppointMe and its officers, directors, employees, and agents shall not be liable for:
Indirect, Incidental, Special, Consequential, or Punitive Damages
This includes but is not limited to:
- Loss of profits, revenue, data, or use
- Missed or cancelled appointments
- Service Provider conduct or service quality
- User-generated content
- Unauthorized access to your account
- Service interruptions or errors
- Disputes between users
Maximum Liability Cap
Any claim against AppointMe shall not exceed the greater of:
- $100, or
- The amount you paid to AppointMe in the past 12 months
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.
Jurisdictional Limitations
Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless AppointMe and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you upload or submit
- Your interactions with Service Providers or other Users
- Any disputes between you and Service Providers
This indemnification obligation survives termination of this Agreement.
12. Dispute Resolution and Service Provider Relations
Disputes Between Users and Service Providers
AppointMe is not a party to any agreement or transaction between Customers and Service Providers. We do not mediate disputes regarding:
- Service quality or outcomes
- Payment disagreements
- Missed or cancelled appointments
- Personal conflicts
Reporting Mechanism
Users may report issues or concerns through the in-app support section. We will review reports to determine if:
- These Terms have been violated
- Content should be removed
- Account suspension or termination is warranted
No Arbitration Obligation
While we encourage informal resolution, reporting an issue does not create an obligation for AppointMe to resolve the dispute or take any specific action.
13. Shop Management and Deactivation
Admin Rights
Admins may deactivate any Shop at their sole discretion if:
- The Shop violates these Terms
- The Shop uploads inappropriate content
- The Shop receives repeated customer complaints
- The Shop engages in fraudulent activity
- Any other reason deemed necessary by AppointMe
Effect of Deactivation
Deactivated Shops will:
- Be unavailable for new bookings
- Not appear in search results
- Retain existing data (subject to our data retention policies)
- Be notified of the deactivation reason (at our discretion)
Reactivation
Shop Owners may request reactivation by contacting support. Reactivation is at AppointMe's sole discretion.
14. Account Termination
Termination by You
You may terminate your account at any time by:
- Using the in-app account deletion feature
- Contacting support to request deletion
Upon termination, your account data will be deleted in accordance with our Privacy Policy (within 30 days).
Termination by AppointMe
We may suspend or terminate your account immediately, without notice, if you:
- Violate these Terms
- Engage in prohibited activities
- Provide false information
- Engage in fraudulent conduct
- Pose a security or legal risk
Effect of Termination
Upon termination:
- Your right to access the Service ceases immediately
- We may delete your account data (subject to legal retention requirements)
- Outstanding obligations survive termination
- Certain provisions of these Terms survive (see Section 15.2)
No Refunds
We do not provide refunds for any fees paid (if applicable in the future) upon account termination, except as required by law.
15. General Provisions
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Israel, without regard to its conflict of law principles.
You agree to submit to the exclusive jurisdiction of the courts located in Israel for resolution of any disputes arising from these Terms or your use of the Service.
Survival
The following provisions survive termination of this Agreement:
- Section 7 (User-Generated Content - License Grant)
- Section 8 (Intellectual Property Rights)
- Section 10 (Disclaimers and Limitation of Liability)
- Section 11 (Indemnification)
- Section 15 (General Provisions)
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AppointMe regarding the Service and supersede all prior agreements and understandings.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
No Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of AppointMe.
Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.
Force Majeure
AppointMe shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
Relationship of Parties
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and AppointMe.
Third-Party Services
The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites. Your use of third-party services is at your own risk.
Export Compliance
You agree to comply with all applicable export and import laws and regulations. You shall not export or re-export the Service to any prohibited country or person.
16. Notices
Notice to You
We may provide notices to you:
- By posting on the Service
- Through in-app notifications
- Via email to the address associated with your account
- By mail to any address you provide

You may provide notices to us:
- Through the in-app support section

All notices must be in writing and shall be deemed delivered:

18. Acknowledgment
By using the Service, you acknowledge that:
- You have read and understood these Terms
- You agree to be bound by these Terms
- You meet the age requirements
- You understand that Service Providers are independent contractors
- You understand AppointMe's limitations of liability
- You accept the risks associated with using the platform
